These Terms of Service (“Terms”) govern your access to and use of the Fantasti Cloud Platform, APIs, and services (collectively, the “Services”). By using our Services, you agree to these Terms.

1. The Service Model

Fantasti acts as an orchestrator of computing resources. The Services rely on provisioning resources from third-party infrastructure providers. The companies that process customer data on Fantasti’s behalf, including those providers, are listed under Sub-processors on our Trust and security page.

By using Fantasti, you acknowledge that your workloads may run on physical infrastructure managed by such a provider. Fantasti abstracts this complexity, providing a unified API, billing, and support layer.

2. Account Registration & Identity

You are responsible for safeguarding your API keys, SSH keys, and authentication tokens. Fantasti Technologies LLC is not liable for any loss or damage arising from unauthorized use of your account resulting from your failure to secure your credentials.

3. Billing, Payments & Credits

  • Metering: Usage is metered by the second and billed hourly.
  • Prepaid credit: Load credit and use it down. Nothing is charged later. Credit does not expire.
  • Pay-as-you-go: A default payment method is kept on file. It is charged at the end of each calendar month, and each time accrued spend passes the spend threshold. A receipt lists the month's spend and the intermediate charges.
  • Card payments: A 2.9% processing fee applies to card payments. Bank transfer carries no fee.
  • Spend threshold: The accrued spend at which a pay-as-you-go account is charged before the month ends. The spend threshold starts at $100 and rises automatically with usage and successful payments. The threshold is reviewed at the end of each calendar month, and a new threshold applies from the next month. Prepaid credit has no spend threshold. Enterprise thresholds are set by contract.
  • Enterprise: Invoice, NET 30, by contract. Invoiced customers must pay within the terms specified. Late payments may result in service suspension.
  • Reserved instances: Require a signed contract. These are “take-or-pay” commitments and cannot be cancelled early without penalty.

4. Confidentiality

“Confidential Information” means non-public information disclosed by one party to the other that is designated as confidential or should reasonably be understood to be confidential. Fantasti agrees to protect your Confidential Information (including your models, data, and usage patterns) with the same degree of care it uses to protect its own, and not to disclose it to third parties except as required to provide the Services (e.g., provisioning VMs with an infrastructure provider) or as required by law.

5. Indemnification

You agree to indemnify, defend, and hold harmless Fantasti Technologies LLC, its officers, directors, and employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content or data you upload or process using the Services.

6. Suspension and Termination

Fantasti reserves the right to suspend or terminate your access to the Services immediately, with or without notice, if: (a) you breach these Terms (including the AUP); (b) your billing account is overdue; (c) we detect fraudulent activity; or (d) required by law or a judicial body. Upon termination, your right to use the Services will immediately cease, and any data remaining on ephemeral instances may be deleted.

7. Copyright Complaints (DMCA)

Fantasti respects the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information in accordance with the Digital Millennium Copyright Act (DMCA):

  • A physical or electronic signature of the copyright owner or authorized person;
  • Description of the copyrighted work claimed to have been infringed;
  • Description of where the material is located on our Services;
  • Your contact information (address, telephone number, email);
  • A statement that you have a good faith belief that the use is not authorized;
  • A statement under penalty of perjury that the information is accurate.

8. Governing Law & Dispute Resolution

All claims arising out of or related to the Terms or the Services will be governed by the laws of the state of California, excluding California’s conflict of laws rules, and will be litigated exclusively in the federal and state courts of Santa Clara County, California, USA.

9. Automated Systems & AI Agents

The service is designed to be operated by AI agents, under written rules and hard limits that the owner sets. Placement, capacity, quota and support on the Fantasti Cloud Platform are designed to be handled by AI agents. Once the agent desks are in service, when you contact Fantasti, you are communicating with an AI agent. Every agent identifies itself as an AI in its first message and in its signature. Automated checks screen sign-ups, payments and launches for fraud and abuse.

Fantasti Technologies LLC is the legal person responsible for the service. Its owner signs its contracts and data-processing agreements, and answers legal process and regulators.

10. Preview Services

The Fantasti Cloud Platform is in Private Preview, and features and the API may change. Individual features are offered at a release stage. The stage of a feature states who can use it, how its interfaces may change, how it is billed, and which service commitments and support apply to it. The release stages are defined under Release stages on our Previews page.
